Description:
This session will provide practitioners with tips, examples and the tools to argue cases under the test of unjustifiably harsh consequences/exceptional circumstances under Article 8 ECHR.
This course will cover:
• When 'exceptional circumstances' / 'unjustifiably harsh consequences' arise
• Appendix FM GEN 3.1-3.3 of the Rules
• Appendix FM SE Para 21(A)
• Home Office Policy Guidance and how to make best use of it
• Authorities on 'unjustifiably harsh consequences' – with analysis of circumstances the Courts have found to meet the test and those which they have not been convinced by
• Case studies
Audience: This course provides an overview for those beginning in this area or are seeker a refresher.
