ILPA: Introduction to Asylum and International Protection

This course is a comprehensive introduction to the areas of asylum and international protection for ILPA members, aimed at practitioners who seek an introduction to or comprehensive view of the asylum application and appeals process.

As a backdrop, we will examine the concepts and operation of immigration control, the hierarchy of entitlements, immigration enforcement, immigration detention and bail.

We will then provide an overview of the legal framework in relation to international protection, including asylum, humanitarian protection and human rights claims. We will explore the entire asylum process from initial claim through to appeals, judicial reviews, fresh claims, outcomes and applications for family reunion, including legal arguments and best evidence at each stage.

We will also consider briefly the intersection of trafficking and modern slavery claims with claims for international protection. We will examine working with vulnerable clients and those lacking capacity. Finally, there will be a brief discussion on funding and legal aid.

The course does not cover the process for Unaccompanied Asylum Seeking Children, NASS, or other support issues.
