Description
The Nationality and Borders Act 2022 is now on the statute book, making radical changes to the UK’s refugee protection regime. And the rule changes that accompany it significantly alter Humanitarian Protection and family reunion rights. Some sections of the Act are already in force:
- Elements of the “no notice” citizenship deprivation process
- Visa penalties for countries posing a risk to international peace and security
More enters force in late June:
- Updated third country certification regime for asylum seekers
- New statutory regime for assessing refugee status: “balance of probabilities” for assessing facts
- Presumption of exclusion from refugee protection for particularly serious crimes for 1-year sentences
- Visa penalties for uncooperative countries
New Immigration Rules herald fundamental changes to refugee protection:
- “Insurmountable obstacles” requirements for refugee partners and children seeking family reunion
- “exceptional circumstances” proviso for unaccompanied children joining refugee relatives & adult children
- Validity provisions for asylum claims
- Revised procedures for Humanitarian Protection claims (and shorter grant of status)
- Renunciation of refugee status
- 30 months grants of refugee protection to Group 2 refugees
We’ll also address the latest thinking re
- Dispersal of asylum seekers to Rwanda
- Achieving settlement protection
- Nationality deprivation
