This training session will provide those working with clients in immigration detention with a practical overview to obtaining bail from detention.
Topics to be covered include:
1. Legal background
a. statutory powers to detain and grant bail
b. unlawful detention and bail
2. Applying for bail
a. To Home Office
b. To FTT
c. To High Court
3. Common issues in applying for bail
a. Release address (including the role of Police and Probation Service in approving premises)
b. Sureties
c. The bail summary
4. What to do when bail is refused
The course will use case studies to assist attendees learning. The course will also consider recent developments and recurring issues that may interrelate with unlawful detention claims.
The course will not cover unlawful detention in detail.
