Key Resource Symbol "Asylum seeker NHS ban 'unlawful'"

(BBC News - 11/04/08) Regulations banning failed asylum seekers from receiving free NHS treatment have been declared unlawful in the High Court (Mitting J) in a test case ruling on a failed asylum seeker from Palestine, unable to return to the West Bank owing to travel restrictions and problems over documentation.

Adam Hundt, of Pierce Glynn, said the rules were leading to "grotesque human suffering". ...."My client is effectively stuck in the UK, even though he is doing all that he can to return home." (Elec. transcript of judgment not yet available)

Frances Webber in IRR News on the "Important legal ruling for refused asylum seekers": " ....bad and good news....The Court of Appeal has ruled that hospitals have a discretion but not a legal obligation to provide treatment for refused asylum seekers.....[it]l held that, since the purpose of the NHS, according to legislation, was to improve the health of the 'people of England' and not 'people in England', this suggested the need for patients to have a legitimate connection with the country...... Adam Hundt, [Pierce Glynn Solicitors] ....was glad that the court had recognised that the DoH's guidance didn't make clinical, economic or humanitarian sense, and called on the DoH to tell hospitals to treat patients who can't pay and can't return home, and not to wait until they are at death's door." Refugee Council response to appeal court ruling on charging asylum seekers for hospital treatment

(30th March 2009) "......we remain concerned that a charging regime for refused asylum seekers still exists at all....We urge [Government] to reconsider the rules in light of the judgment and all the other evidence of the inhumanity of the charging regime and let asylum seekers access treatment at least until they are able to go home.”

Sheffield, Wednesday 3rd June, 11am to 4.30 pm

This conference is a chance to find out how local City of Sanctuary groups are building support for people seeking sanctuary in the UK. Explore how your town or city can build a City of Sanctuary initiative, with support from the national City of Sanctuary network, the Refugee Council and Refugee Action. The day will also include training workshops, delivered by the Refugee Council and City of Sanctuary, including: using the media, fundraising, refugee resettlement and setting up a local City of Sanctuary initiative.

This day conference is free, but places are limited so advance booking is essential.

National Asylum Support Service

From April 2000 support to asylum seekers became the responsibility of the National Asylum Support Service (NASS). The Home Office is now responsible for providing support and accommodation for asylum seekers who would otherwise be destitute, whilst their claim is being considered.

Home Office press release 23 April 2009: Prior to 3 April 2006 the continuous leave requirement for ILR under the HSMP was that migrants should show that they had spent four years' continuous residence in the UK. This was increased to five years' qualifying residence on 3 April 2006. The HSMP Forum Ltd brought a Judicial Review that those who entered onto the HSMP before the increase should be eligible for ILR after four years. The judge found in favour of the HSMP Forum on this point. Click here for the judgment on the EIN. "Work is underway to put the necessary remedies in place. ... We ... ask you not to submit an application based on the outcome of the judicial review, until policy and procedures are published on this website. There will be some people whose leave is due to expire before (or shortly after) the policy and procedures are published on the website. Those people will need to submit an in-time application. If this is the case you can submit an application for indefinite leave to remain (ILR) and this will be held until policy and guidance is published. ... HOME OFFICE BIA: Employers face new fines for illegal working

22 November 2007: Businesses must source migrant labour through legal means or face severe penalties, the Home Office announced today as part of its comprehensive programme to reform Britain’s immigration controls. The Government is setting out new measures to prevent illegal working following a consultation with UK businesses. Under a new system of civil penalties, employers who negligently hire illegal workers could face a maximum fine of £10,000 for each illegal worker found at a business. If employers are found to have knowingly hired illegal workers they could incur an unlimited fine and be sent to prison. These measures take effect in February 2008

"...........From 27 November if you wish to come to the United Kingdom for a short time to conduct business or to take part in sporting or creative events you will need to come as a business, sports or entertainer visitor.

If you are seeking entry as a child visitor, student visitor, parent of a child at school, marriage visitor, prospective student, visitor in transit or a visitor for private medical treatment, you will still need to apply in that category. Under current plans, within three years all foreign nationals from outside the European Economic Area (EEA) will need to have an identity card if they are coming to the United Kingdom for more than six months or extending their stay here.

An independent Identity Commissioner will be appointed in the near future to oversee the National Identity Service, but compulsory identity cards for foreign nationals will continue to be overseen by the Information Commissioner and the Chief Inspector of the UK Border Agency.

Experts say the incidents involving George are the latest examples of unacceptable measures taken by immigration judges seeking to reject asylum claims, raising questions about the integrity of the asylum appeals system."

Dr Alan George said: "This sort of attack can have very serious consequences for one's reputation and on one's livelihood....but ultimately it's justice that is going to suffer."

30 September 2009: In line with the launch of the sponsorship management system for Tier 4 of the points-based system on 5 October 2009, the UK Border Agency has announced new policy for Tier 4 sponsors and would-be students. The new policy centres on two main areas:
1. Extending the maintenance concession for Tier 4 applicants who are already in the United Kingdom - this will help to ease the transition process for would-be students.
2. Tying Tier 4 students' permission to stay to their sponsors, if they make their application on or after 5 October - this will strengthen Tier 4 and strengthen the United Kingdom border.
