(BBC News - 11/04/08) Regulations banning failed asylum seekers from receiving free NHS treatment have been declared unlawful in the High Court (Mitting J) in a test case ruling on a failed asylum seeker from Palestine, unable to return to the West Bank owing to travel restrictions and problems over documentation.
Adam Hundt, of Pierce Glynn, said the rules were leading to "grotesque human suffering". ...."My client is effectively stuck in the UK, even though he is doing all that he can to return home." (Elec. transcript of judgment not yet available)

News on the "Important legal ruling for refused asylum seekers":
" ....bad and good news....The Court of Appeal has ruled that hospitals
have a discretion but not a legal obligation to provide treatment for refused
asylum seekers.....[it]l held that, since the purpose of the NHS, according
to legislation, was to improve the health of the 'people of England' and not
'people in England', this suggested the need for patients to have a legitimate
connection with the country...... Adam Hundt, [Pierce Glynn Solicitors] ....was
glad that the court had recognised that the DoH's guidance didn't make clinical,
economic or humanitarian sense, and called on the DoH to tell hospitals to treat
patients who can't pay and can't return home, and not to wait until they are
at death's door." (3rd April 2009)

hospital treatment
(30th March 2009) "......we remain concerned that a charging regime for
refused asylum seekers still exists at all....We urge [Government] to reconsider
the rules in light of the judgment and all the other evidence of the inhumanity
of the charging regime and let asylum seekers access treatment at least until
they are able to go home.

Sheffield, Wednesday 3rd June, 11am to 4.30 pm
This conference is a chance to find out how local City of Sanctuary groups
are building support for people seeking sanctuary in the UK. Explore how your
town or city can build a City of Sanctuary initiative, with support from the
national City of Sanctuary network, the Refugee Council and Refugee Action.
The day will also include training workshops, delivered by the Refugee Council
and City of Sanctuary, including: using the media, fundraising, refugee resettlement
and setting up a local City of Sanctuary initiative.
This day conference is free, but places are limited so advance booking is
essential.

new National Referral Mechanism will help frontline staff identify victims and

National Policing Improvement Agency (NPIA) will undertake training of new police
officers, and the UK Border Agency will begin a programme of awareness-raising
for staff to prepare for the start of the new measures next year."

Directive]...is a huge infringement of the human rights of our Latin American
friends. It proposes jailing undocumented immigrants for up to 18 months before
their expulsion. Mothers with children could be arrested, without regard to family
and school, and put in detention centres, where we know depression, hunger strikes
and suicides happen. How can we accept it?....I appeal to European leaders to
drop this directive and instead form a migration policy that respects human rights,
and allows us to maintain the movement of people that helps both continents."

Strasbourg, 11.07. 2007 - Commissioner Thomas Hammarberg today presented his report assessing the effective observance of human rights in Germany to the Council of Europe's Committee of Ministers.The report reviews the current state of human rights protection in Germany......Furthermore, the Commissioner recommends a review of the increasing practice of revoking refugee status and the establishment of minimum standards for accommodating asylum seekers.....The Commissioner calls on German authorities to grant residence permits to rejected asylum-seekers who have been subjected to a chain of tolerance ("Duldung") permits over several years, with special consideration afforded to families with children.

Highly skilled migrant programme (HSMP) Forum Judicial Review - Judgement of 6 April 2009 (update) |
Home Office press release 23 April 2009: Prior to 3 April 2006 the continuous leave requirement for ILR under the HSMP was that migrants should show that they had spent four years' continuous residence in the UK. This was increased to five years' qualifying residence on 3 April 2006. The HSMP Forum Ltd brought a Judicial Review that those who entered onto the HSMP before the increase should be eligible for ILR after four years. The judge found in favour of the HSMP Forum on this point. Click here for the judgment on the EIN. "Work is underway to put the necessary remedies in place. ... We ... ask you not to submit an application based on the outcome of the judicial review, until policy and procedures are published on this website. There will be some people whose leave is due to expire before (or shortly after) the policy and procedures are published on the website. Those people will need to submit an in-time application. If this is the case you can submit an application for indefinite leave to remain (ILR) and this will be held until policy and guidance is published. ... Policy and procedures for all those affected by the judgment will be published on or by 20 May 2009." |

for migrants who currently hold HSMP leave and need to apply for an extension.
"You are covered by the judgment if you joined the Highly Skilled Migrant

HOME OFFICE BIA: Employers face new fines for illegal working |
22 November 2007: Businesses must source migrant labour through legal means or face severe penalties, the Home Office announced today as part of its comprehensive programme to reform Britain’s immigration controls. The Government is setting out new measures to prevent illegal working following a consultation with UK businesses. Under a new system of civil penalties, employers who negligently hire illegal workers could face a maximum fine of £10,000 for each illegal worker found at a business. If employers are found to have knowingly hired illegal workers they could incur an unlimited fine and be sent to prison. These measures take effect in February 2008 |

From 2008, a points based system will begin to operate in the United Kingdom. This will manage the flow of individuals wishing to come to or remain in the United Kingdom to work, train or study. One of the requirements will be that, in most cases, migrants coming here to undertake skilled or highly skilled work must provide evidence to demonstrate that they have an acceptable standard of English. UKBA has published "a consultation on proposed reforms to the immigration
appeals process. The reforms are designed to streamline the system. The Government
believes that once fully implemented, the reforms could reduce the amount of time

22 February 2009: "Measures to raise the bar for foreign workers wishing to enter the United Kingdom, and to give domestic workers a greater chance of applying first for United Kingdom jobs" From 1 April the Government will: strengthen the resident labour market test for tier 2 skilled jobs so that employers must advertise jobs to resident workers through JobCentre Plus before they can bring in a worker from outside Europe;use each shortage occupation list to trigger skills reviews that focus on up-skilling resident workers for these occupations, which will make the United Kingdom less dependent on migration for the future; and tighten new criteria against which highly skilled migrants seeking entry to the United Kingdom are judged, by raising the qualifications and salary required for tier 1 of the PBS to a Master's degree and a minimum salary of £20,000.

New countries face tough visa rules |
09 February 2009: Visa checks are to be introduced for five countries after they failed to pass the United Kingdom's strict new Visa Waiver Test - Bolivia, Lesotho, South Africa, Swaziland and Venezuela. The visa regime for Taiwanese passport holders wil be lifted as from 3 March 2009. |

Learning & Skills Council (LSC) announce that ESOL tuition (English for speakers of other languages) will only be funded for unemployed or those in receipt of income based benefits, not adult asylum seekers or migrant workers. NEW UK BORDER FORCE ANNOUNCED |
Statement to UK Parliament, 25 July 2007, Prime Minister Gordon Brown said "Britain
is to have a unified border force to 'strengthen the powers and surveillance

business and special visitor rules
"...........From 27 November if you wish to come to the United Kingdom
for a short time to conduct business or to take part in sporting or creative
events you will need to come as a business, sports or entertainer visitor.
If you are seeking entry as a child visitor, student visitor, parent of a child
at school, marriage visitor, prospective student, visitor in transit or a visitor
for private medical treatment, you will still need to apply in that category.
This group of categories are collectively known as special visitors..........."

visa age to rise
"From 27 November both parties in a marriage will have to be 21 before
a marriage visa can be issued. Raising the age is just one part of the Government's
work to crackdown on forced marriage and on those who attempt to abuse the marriage

Roll-out
of new rules for foreign students (from March 2009): "..............colleges
and universities who want to teach non European Economic Area (EEA) nationals

"...The number of positions available to migrants [under Tier 2]has been
reduced from one million to just under 800,000...Under Tier 2 companies must
pass the Resident Labour Market test by proving they cannot fill the post with
a resident worker before they can bring in someone from outside the EEA. If
the job is on the shortage list the company will not need to pass the test."

UK government response to the 'Visa Waiver Test' |
Home Office Ministerial statement on the 'Visa Waiver Test' Global Review of Visa
regimes, which found that "there was a strong case for introducing a visa
regime for a number of currently visa free countries....The countries we are working
with through the mitigation process are: Bolivia,Botswana, Brazil, Lesotho, Malaysia, Mauritius, Namibia, South Africa, Swaziland,Trinidad and Tobago and Venezuela" (This means that Britain's 'visa net' could be widened
to cover around 80 per cent of the world's population.)

By Afua Hirsch, Guardian legal affairs correspondent (27/10/2008); "[The
AIT]..has admitted making inappropriate remarks about an academic at Oxford University,
issuing a public apology and agreeing to pay costs and damages after he accused
it of libel in what is believed to be the first instance of its kind........[it
has] withdrawn the comments it made about Dr Alan George in a judgment... in which
two judges warned that the accuracy of his evidence should be treated with caution
in future."
"That warning was quickly seized upon by another tribunal......saying
it was entitled to have "fears about his objectiveness". Those
remarks have also now been withdrawn....George, an expert on the Middle East,
had been invited to provide evidence in the case of a woman who was due to be
deported to Lebanon. Experts say the incidents involving George are the latest
examples of unacceptable measures taken by immigration judges seeking to reject
asylum claims, raising questions about the integrity of the asylum appeals system."
Dr Alan George said: "This sort of attack can have very serious consequences
for one's reputation and on one's livelihood....but ultimately it's justice
that is going to suffer."
