The Strategic Legal Fund for Refugee Children and Young People (SLF) has issued its latest bulletin.

The bulletin reports on recent grants awarded, the first tangible outcomes from a project the SLF has funded, a further extension to the pilot project, and developing plans for the future of the SLF.

Of note, the bulletin reports that the first third party intervention which the SLF funded, brought by Refugee Action and represented by the Migrants' Law Project (MLP), contributed to a positive judgement which upholds the rights of asylum seeking children and young people and indeed other people seeking asylum in the UK.

The case of MK & Anor v Secretary of State for the Home Department & Anor [2012] EWHC 1896 (Admin) reviewed delays by the UK Border Agency in making decisions on Section 4 support for destitute asylum seekers who have made further submissions asserting fresh claims for asylum. Refugee Action submitted evidence demonstrating that the delays were prolonging destitution. The judgment states that the government's policy of delaying the consideration of applications for Section 4 support in cases where fresh claims have been made is unlawful.
